NJOY ACE pods come in 2.4% and 5.0% nicotine by weight in Classic Tobacco and Menthol, and in 5.0% only in Rich Tobacco, NJOY says.2 The FDA describes them as sealed, prefilled pods that cannot be refilled and are used with the ACE device.3

Vaping360's product database lists the ACE as released in July 2018 and gives it a size of 88.9 by 27.94 by 12.7 mm and a weight of 62.3 g.4 Vaping360 also reported that Smoore makes the device and pods for NJOY under contract.5

How NJOY ACE Got FDA Authorization

NJOY ACE got FDA authorization in two steps. On April 26, 2022 the FDA issued marketing orders for the ACE device and the Classic Tobacco 2.4%, Classic Tobacco 5% and Rich Tobacco 5% pods, and it denied several other ACE products the same day.6

On June 21, 2024 it added ACE Menthol pods at 2.4% and 5%, part of what it called its first authorization of non-tobacco flavored e-cigarettes.3 Blueberry and Watermelon pods have no marketing order; NJOY resubmitted them in May 2024 for use with the Bluetooth NJOY ACE 2.0 only.7

The NJOY ACE holds FDA marketing orders, so FDA rules are not what keeps it off shelves; since March 31, 2025, ITC patent orders have barred NJOY from importing, marketing, selling and distributing ACE devices and pods in the US.2

Those orders came out of a patent case brought by Juul, in which an ITC judge found on August 23, 2024 that ACE violated four Juul patents.8 Altria said NJOY stopped shipping ACE to wholesalers on March 24, 2025 and that retailers could sell through the stock they already had.9

Will NJOY ACE Come Back?

Whether NJOY ACE will come back is open, and Altria's own plans do not count on it this year: its results released on July 30, 2026 assume ACE does not return to the market in 2026.10

ECIGIntelligence reported on February 3, 2026 that Altria had completed the product design of a modified ACE that addresses all four disputed Juul patents.11 Neither source gives a date for a return. NJOY's statement on the ITC orders is on NJOY's corporate site.

Is the NJOY ACE FDA approved?
