The Mr Fog Switch Pod lacks an FDA marketing order, so it can't be legally sold under federal rules, and it does not appear on the FDA's authorized list current as of August 28, 2026.⁵ It also falls under Pennsylvania's Act 57 enforcement from October 19, 2026, since Mr Fog has no listing in the state's ENDS Directory.⁶
