No berry vape listed on vapes.wiki is legal to sell under federal rules, because none has an FDA marketing order; the FDA calls the 48 products on its authorized list, current as of August 28, 2026, the only e-cigarettes that may be lawfully sold in the United States.1
The FDA's first authorizations in flavors other than tobacco and menthol came on May 5, 2026, for Glas pods it calls Gold and Sapphire.2 News reports described them as fruit flavors; the FDA has not said which fruit each one is.3 The fruit vapes page lists the states that ban flavored vapes outright.
