Where Fruit Vapes Are Banned by State Law

Fruit vapes are banned by state law in Massachusetts, New Jersey, New York, Rhode Island, California and Utah, and in the District of Columbia, all of which bar the sale of flavored e-cigarettes as of October 26, 2026.1234567

Hawaii goes further from January 1, 2027, when only vapes with an FDA marketing order that are listed in the state attorney general's directory may be sold there.8

Are Fruit Vapes FDA Authorized?

Fruit vapes from the brands on vapes.wiki have no FDA marketing orders, and the FDA's list of 48 authorized e-cigarettes, current as of August 28, 2026, is the full list of vapes that may be lawfully sold in the US.9

The only authorized flavors outside tobacco and menthol are two Glas pods the FDA calls Gold and Sapphire, authorized on May 5, 2026 for a device that checks the user's age and identity through a phone app.10
