Fume Extra Nicotine and the 5% Label
Fume Extra nicotine is listed at 5%, and Fume's '5%' labeling was the subject of a proposed class action filed on April 11, 2025 against QR Joy and QR Joy Fume, LLC in the Southern District of Florida, which named the Extra, Ultra, Infinity and Mini as Fume models.6 The complaint alleged that the label misleads buyers.
Law360 reported on October 2, 2025 that a judge dismissed the complaint as a 'shotgun' pleading.7 The docket shows a stipulation of dismissal on July 9, 2026 and the case closed the next day.8
Is the Fume Extra Legal in the US?
The Fume Extra has no FDA marketing order, so it can't be legally sold under federal rules, and it is not on the FDA's list of authorized e-cigarettes, current as of August 28, 2026.9 FDA's Import Alert 98-07 lets the agency detain unauthorized e-cigarettes at the border.10
