Fume Ultra and the 5% Nicotine Lawsuit
The Fume Ultra, listed at 5% nicotine, was one of four Fume models, with the Extra, Infinity and Mini, named in a proposed class action filed on April 11, 2025 against QR Joy and QR Joy Fume, LLC, which alleged that Fume's '5%' nicotine labeling misleads buyers.4
Law360 reported on October 2, 2025 that a federal judge dismissed the complaint as a 'shotgun' pleading, and the docket shows the case closed on July 10, 2026, a day after a stipulation of dismissal.56
Is the Fume Ultra Legal in the US?
The Fume Ultra lacks an FDA marketing order, so it can't be legally sold under federal rules, and it is absent from the FDA's authorized list current as of August 28, 2026.7 It also falls under Pennsylvania's Act 57 enforcement from October 19, 2026, since Fume has no listing in the state's ENDS Directory.8
Texas Senate Bill 2024 makes it a misdemeanor to sell e-cigarette products made wholly or partly in China, and NJOY's 2023 complaint placed Fume's alleged maker in Foshan, China.910
